The Future of DACA and the new DAPA

This past week the United States Supreme Court heard oral arguments from the State of Texas (and other states including Kansas) and the Obama administration regarding President Obama’s Executive Action for DAPA and expanded DACA. It is expected that there will be a decision on the case sometime this summer–in late June or early July. If the Court rules against the States and upholds Obama’s executive action, people could potentially start applying for DAPA and DACA right away. But is that a good idea? Remember, deferred action is a temporary act of discretion by President Obama. So once President Obama leaves office, our next President could end DAPA and DACA. If that happens, all those DAPA and DACA applicants will be denied…and the applicant could be at risk for being placed in removal proceedings. Let’s wait to see what happens with the next Presidential election before making any decisions on DAPA and DACA.
